Conservative Party of Canada uses Judiciary to pursue oppressive right wing agenda

Liberal Justice Critic Marlene Jennings on February 2, 2007 had condemned the Conservative government for its retrograde plan calling for the removal of the discretion used by judges when deciding whether to pursue adult sentences against young offenders.

"This government won't let the facts get in the way of a good scare tactic when it comes to justice policy. The simple fact is that the best people to decide whether or not young offenders should be prosecuted as adults are the judges who are familiar with the case at hand, not politicians in Ottawa," said Ms. Jennings.

Despite Conservative Party misinformation, the Youth Criminal Justice Act (YCJA) currently contains provisions that allow serious crimes, including murder, attempted murder and aggravated sexual assault, to be pursued in adult court.

"Criminal justice is a complex issue, and this government continues to prove they just don't get it. The key is to be effective, and make evidence based decisions. That's what our party did over 13 years, and it resulted in significant reductions in crime statistics across Canada," said Ms. Jennings.

While the Conservative government focuses solely on sentencing reforms, it is ignoring many more effective measures that include rehabilitation and reintegration; measures that are designed to reduce recidivism, and seek to prevent turning 16 and 17 year olds into lifetime criminals.

"The important fact is that Canadians clearly trust judges more than they trust Conservative politicians. That is why our party opposes these measures, and will fight to preserve the judicial independence that is a cornerstone of our justice system," said Ms. Jennings.

"We all want safer communities, and that's why the Liberal Party will work towards effective justice solutions, rather than base partisan attacks when it comes to protecting Canadians."
